This Consignment Agreement has been updated. By consigning items with The Rebel Pony Resale Co., LLC (“TRPR”), you acknowledge that you have read, understand, and agree to all terms below. This Agreement is legally binding.
1. CONSIGNMENT PROCEDURE
TRPR agrees to process and determine the salability of Consignor’s items and, if deemed fit for resale, market the items for sale. Upon sale, TRPR shall retain its commission and remit the remaining sales revenue to Consignor, less any applicable costs.
Accepted items are listed on our website and may change at any time. If you have questions regarding acceptability, please contact TRPR prior to shipping. Mail-in consignments require a minimum of $125 in retail value per shipment.
TRPR determines pricing on all accepted items. Consignor will receive an itemized list of accepted items. A new Agreement is required for each consignment submission.
2. UNACCEPTABLE ITEMS
TRPR reserves the right to reject any item for resale, for any reason, at its sole discretion. Items must be in very good condition up to new with tags, as determined by TRPR.
If return shipping is prepaid, rejected items may be returned. If return shipping is not prepaid, Consignor forfeits all right, title, and interest in such items, which may be disposed of at TRPR’s discretion, including donation, recycling, or resale.
3. PROCESSING FEE
For convenience, TRPR may provide prepaid shipping labels using discounted carrier rates. Use of a TRPR prepaid label incurs a $15 processing fee per shipment, deducted from monthly sales. TRPR reserves the right to charge market shipping surcharges when applicable.
4. SALES REVENUE & PAYMENT TIMING
Consignor will receive payment one month following the month of sale.
5. DISCOUNTS

All items are consigned for a minimum of 120 days (4 months). To keep inventory fresh and sales moving, we may apply strategic markdowns:

If items remain unsold after 121 days, TRPR may further discount or remove them from inventory. Consignor will be notified and may elect to:
7. SHIPPING COSTS
Partial shipping costs related to returns or free-shipping promotions may be deducted from sales proceeds and distributed evenly across affected items. Shipping deductions will not exceed 15% of the item’s selling price.
8. CLEANING & REPAIR
TRPR does not clean, launder, or repair items. Items requiring such services will be returned to Consignor at Consignor’s expense.
9. TRPR COMMISSION SCALE
Items priced at $24 and under are ineligible for consignment and will be handled per Section 2.
Commission Payouts:
$900+ → 75% to Consignor
$600–$900 → 65%
$400–$600 → 55%
$200–$400 → 50%
$25–$200 → 40%
If Consignor elects to receive payment via donation or TRPR Store Credit, a reduced commission applies. If no payment method is selected, payment defaults to check.
10. INDEMNIFICATION
Consignor agrees to indemnify, release, defend, and hold harmless TRPR and its officers, directors, employees, successors, and assigns from any and all claims, liabilities, damages, and expenses, including attorneys’ fees, arising from this Agreement.
11. WARRANTY
Consignor warrants full ownership of all consigned items and that items are free from liens or encumbrances. TRPR employs standard safeguards but assumes no responsibility for items handled or disposed of in accordance with policy.
12. RISK OF LOSS
Risk of loss during shipment to TRPR remains with Consignor. TRPR prepaid shipping includes $100 standard insurance. Additional insurance is the responsibility of the Consignor. TRPR assumes risk only upon receipt of items.
13. ASSIGNMENT
This Agreement may not be assigned or transferred without prior written consent of the other party.
14. MEDIATION
Any dispute arising under this Agreement shall first be submitted to confidential mediation, with costs shared equally, before any legal action is filed.
15. DEFAULT
In the event of a material breach, the non-breaching party may terminate this Agreement and recover allowable costs.
16. ATTORNEYS’ FEES
The prevailing party in any action related to this Agreement shall be entitled to recover reasonable attorneys’ fees and costs.
17. VOLUNTARINESS
Each party acknowledges entering into this Agreement knowingly, voluntarily, and believing it to be fair and reasonable.
18. SEVERABILITY
If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
19. GOVERNING LAW & VENUE
This Agreement shall be governed by the laws of the State of Colorado, with venue in Douglas County, Colorado.

By executing this Agreement, Consignor represents and warrants that they have read, understand, and voluntarily agree to all terms, conditions, and policies of this Agreement and TRPR’s Terms of Service, and acknowledge that this Agreement is legally binding.
